We may also aggregate or de-identify the information described above. Aggregated or deidentified data is not subject to this Privacy Policy.

We may disclose identifiers; government-issued identification; demographic information; commercial information; geolocation data; device information; audio, electronic, visual information; internet or other electronic network activity; user generated content and communications; and inferences drawn from this information, as described above, to service providers and business partners for a variety of purposes related to the Services.  These purposes include payment card processing, website and data hosting, product and service delivery, customer service, advertising and marketing (including using cookies, pixels, SDKs, and similar tools for consent based analytics and advertising where required, direct e-mail and SMS marketing, newsletters, counting ad impressions, ensuring compliance with industry standards, personalization, and analytics), analytics services, security and performance monitoring, maintaining and servicing accounts, processing or fulfilling orders and transactions, administering Promotions, verifying customer information, research, verifying customer information, data hosting, auditing, and data processing. • Third-Party sponsors and co-sponsors. We may disclose identifiers; demographic information; commercial information; geolocation data; device information; audio, electronic, visual information; internet or other electronic network activity; user generated content and communications; and inferences drawn from this information, as described above, with select third party sponsors or co-sponsors to market and advertise the Services and to enable your registration and participation in events and Promotions so that they can provide you with, for example, offerings and to support event registration and participation (virtual or in person).You may elect to disclose your personal information to a third-party sponsor or co-sponsor in order to receive marketing offers or other information from the sponsors. If you access third-party services, such as social media sites or other sites linked through the Services (including links to videos on our Services hosted by third parties such as YouTube or Vimeo), these third-party services will be able to collect personal information about you, including information about your activity on the Services, and they may notify your connections on the third-party services about your use of the Services, in accordance with their own privacy policies. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates. 

In addition, if you choose to engage in public activities on the Services, including for instance if you engage on message boards, chat, profile pages, blogs, or our Social Media Pages, you should be aware that any information you post or disclose will become public information. Users of the Services and the general public may read, collect, or use that information. We urge you to exercise caution when disclosing your information. We are not responsible for the information you choose to submit in these public areas.

VI.    DATA SECURITY

We use reasonable organizational, technical and administrative measures to protect personal information within our organization. You should understand that no data transmission or storage system can be guaranteed to be 100% secure. Please note that personal information collected by third parties may not have the same security protections as personal information you submit to us, and we are not responsible for protecting the security of such personal information.

VII.    DATA RETENTION

We will retain the personal information we collect only for so long as reasonably necessary for the purposes and criteria outlined in this Privacy Policy, including the purpose for which it was collected, our business needs, and our legal and regulatory obligations. When determining retention of personal information, we take into account the length of time personal information is required to be retained to provide the Services for which the information was collected; to satisfy legal and compliance obligations and for audit purposes; to address any complaints regarding the Services; to address any relevant litigation or regulatory investigations; and to defend or bring potential legal claims. After such retention period, the personal information will be destroyed or deleted.

VIII.    MINOR INFORMATION

We do not knowingly collect personal information from children under the age of 16. We do not knowingly sell or share for cross-context behavioral advertising or engage in targeted advertising using the personal information of consumers under the age of 16. 

IX.    INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

The Services are controlled and operated by us from the United States. Your personal information may be disclosed and stored outside your province, state, territory or country of residence. Where we transfer your personal information internationally, including from the European Economic Area (EEA) or the United Kingdom to countries such as the United States, we ensure that appropriate safeguards are in place to protect your data. These safeguards include the use of Standard Contractual Clauses (SCCs) approved by the European Commission and the UK International Data Transfer Agreement or the UK Addendum to the SCCs, as applicable. We also conduct assessments and implement supplementary measures where necessary to ensure that your personal information receives a level of protection essentially equivalent to that provided under the GDPR and UK GDPR. For internal transfers within our corporate group, we rely on an intra-group data transfer agreement that incorporates similar safeguards. Right to Opt-Out of Selling, Sharing, or Targeted Advertising:  Our disclosure of your personal information to certain third-party providers and/or use of certain tracking technologies may be considered a “sale,” “sharing,” or “targeted advertising” under certain United States privacy laws. Notice Regarding Loyalty Programs and Financial Incentives

Monster and its affiliates provide offerings and programs to help reward and thank loyal customers for purchasing products.  For example, we may provide special offers as part of certain rewards programs, Promotions, campaigns, or other similar offerings.  These rewards and special offers are not conditioned upon your provision of, or our collection of, your personal information. Your participation in the programs is optional and you can withdraw your participation at any time through the options detailed in the program terms or by contacting us using any of the methods described in the “Contact Us” section of this Privacy Policy. 

We collect and use the categories of personal information (some of which may qualify as sensitive personal information under applicable law) listed in the “Personal Information We Collect” section of this Privacy Policy to operate these programs.  We also partner with third parties to offer these programs, including service providers and business partners, and third-party sponsors and co-sponsors. In addition to withdrawing from the program, you can request deletion of your personal information as described in this Privacy Policy.  If you submit a request to delete your personal information collected in connection with a program, deleting such data may impact your ability to participate in or have access to such program because such data is necessary to provide you with program benefits. Based on our reasonable and good faith estimate, we receive value from programs in the form of increased customer engagement with Monster and its affiliates’ products and brands, though any value will vary by customer depending on how they engage with the program.  

Other California Rights:

1. Shine the Light: California residents who provide certain personal information in connection with obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year.
2. Global Privacy Control and Do Not Track Signals: Our website recognizes and honors Global Privacy Control (GPC) signals. If your browser or device sends a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information (as applicable under relevant privacy laws, such as the California Consumer Privacy Act (CCPA) and similar laws).  When we detect a valid GPC signal, we will automatically apply your opt-out preferences to your browser or device without requiring any additional action from you. Please note that this setting will apply only to the browser or device from which the GPC signal is sent.  We do not currently process or comply with any web browser’s “do not track” signal or similar mechanisms.
